Terms of Service

1. Scope and Provider

These Terms of Service ("Terms") govern your use of the Pulse website, dashboard, and API ("Service") operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

Pulse provides:

  • A Dashboard for monitoring trending subjects, sentiment analysis, claims, and news intelligence
  • An API (Pulse API) for programmatic access to the same data
  • AI-powered queries for natural-language analysis of tracked subjects
  • Alert rules with email and Telegram notifications

The Service is provided "as is" and may be modified, updated, or discontinued at any time with reasonable notice.

3. Account Registration

To use the Service, you must:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your password and API keys
  • Not share your account credentials with others

You are responsible for all activity under your account. Notify us immediately at support@devls.tech if you suspect unauthorized access.

4. Dashboard Tiers and Features

4.1 Available Tiers

All prices are in US Dollars (USD). Applicable taxes (VAT) are added at checkout.

4.2 API Access

API access is available separately through RapidAPI with its own tier structure (BASIC, PRO, ULTRA, MEGA). API subscriptions through RapidAPI are governed by RapidAPI's terms.

5. Acceptable Use

5.1 Permitted Use

You may use the Service to:

  • Build applications and integrations using the API
  • Conduct research and analysis
  • Create dashboards and reports
  • Power automated workflows

5.2 Prohibited Use

You may NOT:

  • Resell or redistribute raw API data without permission
  • Circumvent rate limits, access controls, or security measures
  • Scrape or harvest data beyond what the API provides
  • Build a competing service using our data
  • Use the Service for illegal purposes or to violate third-party rights
  • Transmit malware, spam, or malicious content
  • Attempt to gain unauthorized access to our systems

Violation of these rules may result in immediate suspension or termination of your account.

6. Billing and Payment

6.1 Subscription Billing

  • Subscriptions are billed monthly in advance on the date you subscribe
  • Payment is required immediately — there is no free trial for paid tiers
  • All payments are processed securely by Stripe, Inc.
  • We accept major credit/debit cards and SEPA Direct Debit (EU)
  • Your payment information is stored by Stripe, not by us

6.2 Automatic Renewal

Your subscription automatically renews each month unless you cancel before your next billing date. We will send a renewal reminder email 3 days before your billing date.

6.3 Upgrading

When you upgrade, you get immediate access to the new tier's features. You are charged the prorated difference for the remainder of your billing period.

6.4 Downgrading and Cancellation

  • Downgrading: You keep access to your current tier until the end of your billing period, then transition to the lower tier. No prorated refund is issued.
  • Cancellation: You can cancel at any time from Dashboard > Settings > Subscription. Access continues until the end of your current billing period, then your account reverts to the Free tier.

6.5 Failed Payments

If payment fails, we will retry up to 4 times over 7 days. During this period, you retain access to paid features. If all retries fail, your subscription is canceled and your account is downgraded to the Free tier.

6.6 Price Changes

We may change subscription prices with at least 30 days advance notice via email. Price changes take effect on your next billing date after the notice period. If you disagree with a price change, you may cancel before it takes effect.

7. Taxes

7.1 VAT

  • EU customers: VAT is charged based on your country's applicable rate
  • Other countries: Local taxes may apply based on your jurisdiction
  • All applicable taxes are shown during checkout

7.2 Business Customers (B2B)

If you are a business customer with a valid EU VAT ID:

  1. Enter your VAT ID during checkout or in the Billing Portal
  2. Reverse charge rules may apply (VAT exemption for valid intra-EU B2B transactions)
  3. Your VAT ID will be validated before any exemption is applied

7.3 Invoices

All invoices are available in your Dashboard under Settings > Subscription > Invoice History. Invoices include your billing information, tax amounts, and invoice number for your records.

8. Right of Withdrawal (EU Consumers)

If you are a consumer based in the European Union, you have the right to withdraw from your subscription within 14 days of your initial purchase, without giving any reason (Widerrufsrecht).

8.1 How to Withdraw

Send a clear statement of your decision to withdraw to:

To meet the deadline, it is sufficient to send your communication before the 14-day period expires.

8.2 Effects of Withdrawal

  • We will reimburse all payments received from you using the same payment method, without undue delay and within 14 days of being informed of your withdrawal
  • If you have used the Service during the withdrawal period, we may deduct a proportionate amount corresponding to the service provided up to the time of withdrawal

8.3 Expiry of Withdrawal Right

The right of withdrawal expires 14 days after the conclusion of the contract. For renewal periods, the statutory withdrawal right does not apply, but you can always cancel your subscription as described in Section 6.4.

9. Refunds

9.1 Eligible for Refund

Beyond the EU withdrawal right (Section 8), you may be eligible for a refund if:

  • You experienced a significant service outage (more than 24 consecutive hours) that prevented you from using the Service
  • You were charged in error (e.g., duplicate charges)
  • A technical issue on our end prevented access to paid features

9.2 Not Eligible for Refund

Refunds are generally not provided for:

  • Change of mind after the 14-day withdrawal period
  • Unused portion of the subscription after voluntary cancellation
  • Failure to cancel before the renewal date
  • Account suspension due to violation of these Terms

9.3 How to Request a Refund

Email support@devls.tech with your account email, the reason for your request, and the date of the charge. We will review your request and respond within 5 business days. Approved refunds are processed within 5-10 business days.

9.4 Chargebacks

Please contact us before initiating a chargeback with your bank. Chargebacks may result in additional fees, immediate account suspension, and inability to create future accounts.

10. Intellectual Property

  • The Service and its content (software, data, analysis, design) are protected by copyright and other intellectual property laws
  • You retain ownership of applications you build using the API
  • You may not use our trademarks, logos, or branding without written permission
  • We retain all rights to the underlying data, analysis results, and AI-generated content

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that:

  • We collect and process personal data as described in the Privacy Policy
  • API responses may be cached on our systems
  • You are responsible for your use of data obtained through the Service

12. Availability and Maintenance

We aim to provide reliable service but do not guarantee uninterrupted availability. We may perform maintenance at any time. Scheduled maintenance will be announced in advance where possible.

13. Disclaimer of Warranties

To the extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Data will be accurate, complete, or current
  • The Service will meet your specific requirements

Note: Statutory warranty rights under German and EU law remain unaffected.

14. Limitation of Liability

To the extent permitted by applicable law:

  • Our total liability for damages arising from or related to the Service is limited to the fees you paid in the 12 months prior to the claim
  • We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities

Note: This limitation does not apply to liability for intent or gross negligence, injury to life, body, or health, or other cases where liability cannot be excluded under German law (BGB §§ 309, 276).

15. Indemnification

You agree to indemnify and hold harmless the provider from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees
  • Use the Service in a way that harms others or our systems

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (IP, liability, indemnification) will remain in effect.

17. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days in advance. Continued use of the Service after the effective date of changes constitutes acceptance. If you disagree with the changes, you may cancel your account before they take effect.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection laws of your country of residence remain applicable.

18.2 Jurisdiction

For business customers, the exclusive place of jurisdiction is Osnabrueck, Germany. For consumers, the statutory jurisdiction rules apply.

18.3 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr/

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be replaced by an enforceable provision that comes closest to the original intent.
